Land Acquisition Ordinance : Government-Corporate nexus against people and democracy

The Land Acquisition, Rehabilitation and Resettlement Act 2013 (LARR Act 2013) was enacted in the parliament after incorporating suggestions from the BJP and with its due support. Sumitra Mahajan, presently the speaker of the Lok Sabha, then had headed the Parliamentary Committee, which okayed the law. The LARR Act 2013 which came into effect from January 2014 empowers land-owners, for the first time, with the right to fair compensation for acquired land alongwith consent right. As per the Act the provisions to pay fair compensation to the farmers and seek their prior consent were to be implemented over and above the existing 13 laws in the matter within a year’s time. The LARR Act 2013 was meant to replace the Land Acquisition Act of colonial times enacted in 1894. The staggering destitution of peasants and tribals, social unrest and environmental devastation resulting from the post 1991 new economic policies had forced the UPA government to enact this law. This law mandates prior permissions of 70 percent land-owners in cases where land is acquired by the government, and prior permission of 80 percent land-owners, in cases of acquisitions by private companies. Alongwith this, Social Impact Assessment (SIA) has also been made mandatory.
The ordinance promulgated by the present government on the last day of December 2015 adds Section 10 A to the Act which undoes the rights which the land-owners got in LARR Act 2013. As per this Section five areas – national security, defence and defence production projects; industrial corridors projects; rural infrastructure projects; infrastructure/social infrastructure projects, mostly fall under the public private partnership (PPP); and housing projects for the poor – will not require either prior consent or Social Impact Assessment. It is a matter of speculation if any areas are left out of these five! For these five areas, even fertile multi-crop cultivable land can be acquired straightaway. The government decided to bring in this amendment to the LARR Act 2013 after the winter session was over. When the president inquired into the reasons as to the hurry regarding the matter, three ministers on the part of the government clarified their reasons and the president’s permission was promptly obtained. Thus, whatever role the peasants and tribals had come to have in the process of the acquisition of their lands as per this law was snatched by this amendment and placed back instead into the hands of bureaucracy and corporate houses. Whatever justifications the BJP leaders are giving for this amendment, ought to have been given at the time of its enactment. Explicitly, the government has arranged for the support of the corporate houses in the Lok Sabha elections by bringing the amendment in such hasty manner.
It seems as if the corporate houses have placed their bet on Narendra Modi instead of Manmohan Singh and Sonia Gandhi because they were aggravated by MNREGA, Land Acquisition Act, Food Security Act and the like. Manmohan Singh was an economist prime minister who followed the classicist approach towards neo-liberal reforms whereas Narendra Modi is taking blind leaps. BJP’s propaganda against Manmohan Singh as a weak prime minister is misleading; nonetheless, it proved to be an effective winning campaign in the recently held general election. As the progenitor and facilitator of neo-liberalism in India, Manmohan Singh will be remembered as the strongest prime ministers ever. He removed India’s economic policy and its goal from the axis of the Constitution and installed it instead on the axis of various power stations of neo-liberalism like World Bank, IMF, WTO, World Economic Forum, various multi-national companies and so on. He believed in all wisdom that the capitalist way to growth is the only right way. From the Harshad Mehta scandal to the numerous scandals in his tenure nothing ever even brought the slightest shadow on his brow. This is because he honestly believed that the path of capitalist development has to traverse through corruption. Narendra Modi is an extension of Manmohan Singh because the same policies and practices are being carried forward by his government too.
It is inherent in the spirit of the Constitution as well as reiterated by the Supreme Court in 1987 that amendments ought to be brought only during an emergency or an extraordinary situation. It will be well to remember that the sequence of ordinances had begun in Manmohan Singh’s tenure as finance minister. The Vajpayee government swiftly carried it forward. The UPA 2 government too was a government of ordinances promulgating at least 5 ordinances in a year. But the current government in its seven month tenure by bringing nine ordinances during and after the parliament session has delivered the severest blow to the parliamentary democracy till date. To say that amendments harm parliamentary democracy is – as some other critics have  observed – merely a technical objection. The pertinent question is why did the previous ones or the present government resort to it. The only possible answer is that governments do so in the interest of the global bodies of corporate capitalism, multi-national companies and corporate houses in the country. Thus, it is a one-sided power play that ruins the already marginalized farmers and forest-dwellers.   
In the neo-liberal times, elections have become extremely expensive. According to news reports, in the last parliamentary elections, the BJP spent twenty to twenty five thousand crores and the Congress spent about ten to fifteen thousand crores. This money comes from corporate houses. Prime ministerial candidates openly participate in the conclaves and conferences of capitalists and solicit their support saying ‘make us win and we will do your bidding’. Indian democracy has, thus, been hijacked by corporate houses. The BJP government under the prime ministership of Narendra Modi, just after its formation, had made it clear that it intended to amend the 4 months old LARR Act 2013. It considers the thirty percent mandate to be a gift of corporate houses, not of the voters. In such a scenario, the interests of big business houses become that of utmost importance to the government. The point is, if the money of corporate houses is not kept out of elections, it will not be possible to keep out the ordinances promulgated in their interest.
With this ordinance the already complicated issue of water, forest and land (Jal, Jungle, Jameen) will become even more confounded. Expensive compensations against acquired lands do not ensure salvation for farmers and tribals. Most farmers have small land holdings and that is  their private property. With land acquisition, they belong neither here nor there. The compensation is usually blown up in frivolous expenditures and addictions. Very few people are able to invest the compensation money judiciously for the future. Non-land-owners like dalits and craftsmen castes who depend on farming land for their livelihood did not receive any compensation amount, residential plots or jobs right from the times of the Land Acquisition Act of 1894. In such a situation, land acquisition without prior consent or any social impact assessment will invariably lead to social discontent, and might even increase naxalite violence.
The important lesson in the Land Acquisition Ordinance is that the supposedly apolitical efforts of a few good people (who wish to bring respite to farmers-tribals-labourers by working within the fold of neo-liberalism as advisors to the governments) cannot be a permanent solution. They will have to understand that the awareness and participation of the people that they talk about in their NGO endeavour means nothing without active political participation.
Most parties, including the Congress, have opposed this ordinance. Many peoples’ organizations, farmers’ unions and important citizens have also opposed it. Justice Rajindar Sachar has expressed harsh criticism in his statements as well as columns. He is equally opposed to the Insurance and Coal Mines ordinances. The farmer cell of the BJP too has opposed the ordinance as its affiliate trade union Bharatiya Mazdoor Sangh (BMS) participated in the token strike of the Coal Mines Workers Union along with other trade unions against promulgation of the Coal Ordinance. This protest is meaningful only if all these parties and organizations identify, recognize and oppose the root cause. That is, the neo-liberal economic policies and the capitalist model of development.
Alongwith opposition to the ordinance, some important measures must also be taken. Political parties must fight for the strengthening of the LARR Act 2013, and they must also insist on the formation of a Land Use Commission, as has been demanded by the Socialist Party (India). This commission must have comprehensive representation of farmers, tribals and non-land-owners of villages. The farmers have played an important role in the freedom movement. It has had several important leaders and thinkers including Gandhi himself. In the post independence era, from Chaudhary Charan Singh to Mahantha Devaru Nanjundaswamy, Kishan Patnaik and Sachidanand Sinha, there have been people who have deeply deliberated upon the nature and problems of agriculture and agriculturists vis-a-vi industrialization in previously colonized countries including India. This unique legacy must become a part of the present discourse of development/progress. There are peasant movements and leaders world over, even in the Europe, who oppose the conditions imposed by the WTO in the interest of certain multi-national companies operating in agriculture sector. Lessons can be learnt from these movements.

लोकतंत्र और जनता के विरुद्ध सरकार और कारपोरेट की दुरभिसंधि

भूमि अधिग्रहण, पुनर्वास और पुनर्स्‍थापना कानून 2013 भाजपा के सुझावों को शामिल करके उसके समर्थन से संसद में पारित हुआ था। कानून को स्वीकृति देने वाली संसदीय समिति की अध्यक्ष सुमित्रा महाजन थीं जो वर्तमान लोकसभा की अध्यक्ष हैं। यह कानून जनवरी 2014 से अमल में आया। इस कानून में अधिग्रहण की जाने वाली जमीन के लिए किसानों को उचित मुआवजा देने और उनकी पूर्व अनुमति संबंधी प्रावधानों को पहले के 13 कानूनों पर एक साल के अंदर लागू करने की व्यवस्था भी की गई थी। उपनिवेशवादी दौर के 1894 के भूमि अधिग्रहण कानून की जगह यह कानून लाया गया था। 1991 में लागू की गई नई आर्थिक नीतियों के चलते किसानों-आदिवासियों की भारी तबाही, सामजिक तनाव और पर्यावरण विनाश के चलते दबाव में आई यूपीए सरकार ने यह कानून बनाया। इसके तहत भूमि अधिग्रहण यदि सरकार द्वारा होता है तो 70 प्रतिशत और कंपनियों द्वारा सीधे होता है तो 80 प्रतिशत लोगों की स्वीकृति अनिवार्य है। इसके साथ ‘सामाजिक प्रभाव आकलन (एसआईए) का प्रावधान भी अनिवार्य बनाया गया है।
अध्यादेश में कानून की धारा 10 ए में संशोधन किया गया है कि पांच क्षेत्रों - औद्योगिक गलियारों, पीपीपी (सार्वजनिक निजी भागीदारी परियोजनाओं), ग्रामीण ढांचागत सुविधाओं, रक्षा उत्पादन और आवास निर्माण योजनाओं - के लिए किए जाने वाले भूमि अधिग्रहण में पूर्व अनुमति और एसआईए की बाध्यता नहीं होगी। इन क्षेत्रों के लिए बहुफसली सिंचित जमीन भी सीधे ली जा सकती है। सरकार ने यह अध्यादेश लाने का फैसला संसद का शीतकालीन सत्र समाप्त होने पर 29 दिसंबर को किया। राष्ट्रपति ने जल्दबाजी का कारण पूछा तो सरकार के तीन मंत्री उन्हें स्पष्टीकरण दे आए और राष्ट्रपति की मंजूरी मिल गई। इस कानून से किसानों-आदिवासियों की उनकी जमीन के अधिग्रहण की प्रक्रिया में जो भूमिका बनी थी, अध्यादेश ने उसे खत्म कर फिर से नौकरशाही और कारपोरेट घरानों को दे दिया है। इन संशोधनों के पक्ष में भाजपा नेता जो तर्क दे रहे हैं, वे कानून बनने के समय देने चाहिए थे। जाहिर है, अध्यादेश लाकर सरकार ने आम चुनाव में कारपोरेट घरानों के समर्थन का मोल चुकाया है।   
ऐसा माना जाता है कि कारपोरेट घरानों ने मनरेगा, भूमि अधिग्रहण कानून और खाद्यान्न सुरक्षा कानून जैसे कदमों से खफा हो मनमोहन सिंह-सोनिया गांधी की जगह नरेंद्र मोदी पर दांव लगाया था। मनमोहन सिंह शास्त्रीय ढंग से नवउदारवाद के रास्ते पर चलने वाले अर्थशास्त्री प्रधानमंत्री थे। जबकि नरेंद्र मोदी अंधी छलांगें लगा रहे हैं। भाजपा का मनमोहन सिंह को कमजोर प्रधानमंत्री बताने का प्रचार निराधार था। हालांकि, चुनावी जीत में वह प्रचार काफी कारगर रहा। वे भारत में नवउदारवाद के जनक और प्रतिष्ठापक के बतौर सबसे मजबूत प्रधानमंत्री के रूप में याद किए जाएंगे। उन्होंने भारत की आर्थिक नीति और उसके लक्ष्य को संविधान की धुरी से उतार कर नवउदारवादी प्रतिष्ठानों – विश्‍व बैंक, अंतरराष्ट्रीय मुद्रा कोष, विश्‍व व्यापार संगठन, विश्‍व आर्थिक मंच, विविध बहुराष्ट्रीय कंपनियों आदि - की धुरी पर प्रतिष्ठित कर दिया। वे पूरी समझदारी से मानते थे कि विकास का पूंजीवादी रास्ता ही ठीक है। हर्षद मेहता प्रकरण से लेकर भ्रष्टाचार के अद्यतन घोटालों तक उनकी पेशानी पर शिकन नहीं आती थी तो इसीलिए कि वे ईमानदारी से मानते थे कि पूंजीवादी विकास का रास्ता भ्रष्टाचार से होकर गुजरता है। नरेंद्र मोदी मनमोहन सिंह का ही विस्तार हैं, इसलिए उनकी सरकार में वही सब नीतियां और कारगुजारियां हैं। लेकिन दोनों में फर्क भी है। मनमोहन सिंह न सत्ता के भूखे थे, न नवउदारवादी उपभोक्तावाद की चकाचैंध से आक्रांत। नरेंद्र मोदी के अति उत्साह के पीछे ये दो कारक सर्वप्रथम हैं।
यह संविधान की मूल भावना में है और 1987 में सुप्रीम कोर्ट ने भी कहा है कि अध्यादेश आपात अथवा असामान्य स्थिति में ही लाना चाहिए। ध्यान किया जा सकता है कि अध्यादेशों का सिलसिला मनमोहन सिंह के वित्तमंत्री काल में ही शुरू हो गया था। वाजपेयी सरकार ने उसे तेजी से आगे बढ़ाया। यूपीए सरकार भी अध्यादेशों की सरकार थी। लेकिन सात महीना अवधि की मौजूदा सरकार ने संसद के सत्र के समानांतर और समाप्ति पर नौ अध्यादेश लाकर संसदीय लोकतंत्र को अभी तक का सबसे तेज झटका दिया है। यह कहना कि अध्यादेशों से संसदीय लोकतंत्र को आघात पहुंचता है, जैसा कि कुछ अंग्रेजी टिप्पणीकारों ने भी कहा है, महज तकनीकी आलोचना है। सवाल है कि पहले की या मौजूदा सरकार ऐसा क्यों करती हैं? इसका उत्तर यही हो सकता है कि सरकारें यह कारपोरेट पूंजीवाद के वैश्विक प्रतिष्ठानों, बहुराष्ट्रीय कंपनियों, कारपोरेट घरानों के हित में करती हैं।
नवउदारवादी दौर में चुनाव अत्यंत मंहगे हो गए हैं। खबरों के अनुसार पिछले आम चुनाव में भाजपा ने बीस से पच्चीस हजार करोड़ और कांग्रेस ने दस से पंद्रह हजार करोड़ रुपया खर्च किया। यह धन कारपोरेट घरानों से आता है। प्रधानमंत्री बनने के दावेदार नेता पूंजीपतियों के संगठनों/सम्मेलनों में शामिल होकर खुले आम कहते हैं, हमें जितवाइये हम आपका काम करेंगे। भारतीय लोकतंत्र को कारपोरेट घरानों ने हाईजेक कर लिया है। भूमि अधिग्रहण कानून लागू होने के चार महीने बाद नरेंद्र मोदी के प्रधानमंत्रित्व में बनी भाजपा सरकार ने उसे बदलने की मंशा जाहिर कर दी थी। तीस प्रतिशत समर्थन को वह मतदाताओं की नहीं, कारपोरेट घरानों की देन मानती है। ऐसे में बड़े बिजनेस घरानों का हित सरकार के लिए सर्वोपरि हो जाता है। चुनाव में कारपोरेट घरानों का धन नहीं रुकेगा तो उनके हित में लाए जाने वाले अध्यादेश भी नहीं रुकेंगे।  
इस अध्यादेश से जल, जंगल, जमीन का पहले से उलझा मसला और जटिल होगा। मंहगा मुआवजा मिल जाने से किसानों-आदिवासियों का मोक्षनहीं हो जाता है। ज्यादातर किसान छोटी जोत वाले होते हैं। जमीन अधिग्रहण के चलते उनमें ज्यादातर न घर के रहते हैं न घाट के। मोटा मुआवजा अक्सर फिजूलखर्ची और व्यसन में जल्दी ही खत्म हो जाता है। बहुत कम लोग मुआवजे का समझदारी से दूरगामी उपयोग कर पाते हैं। गांव की जमीन पर निर्भर रहने वाली दलित एवं कारीगर जातियों को 1894 के भूमि अधिग्रहण कानून के समय से ही कोई मुआवजा राशि, आवासीय प्लाट या नौकरी नहीं मिलती है। ऐसे में बिना पूर्व अनुमति और सामाजिक प्रभाव आकलन के जमीन अधिग्रहण से सामाजिक विग्रह तो बढ़ेगा ही, नक्सली हिंसा में इजाफा हो सकता है।
भूमि अधिग्रहण अध्यादेश का एक महत्वपूर्ण सबक यह है कि कुछ भले लोगों का नवउदारवादी दायरे में सरकार के सलाहकार बन कर किसानों-आदिवासियों-मजदूरों को कुछ राहत दिलवाने का गैर-राजनीतिक प्रयास स्थायी नहीं हो सकता। उन्हें समझना होगा कि जनता की जिस जागरूकता और सक्रियता की बात वे अपने एनजीओ कर्म के तहत करते हैं, उसका बिना राजनीतिक सक्रियता के कोई अर्थ नहीं है।  
कांग्रेस समेत ज्यादातर पार्टियों ने इस अध्यादेश का विरोध किया है। कई जन संगठन, किसान संगठन और महत्वपूर्ण लोग भी विरोध में हैं। जस्टिस राजेंद्र सच्चर ने अपने बयानों और लेखों में कड़ी आलोचना दर्ज की है। हो सकता है भाजपा का किसान प्रकोष्ठ भी विरोध करे। उससे संबद्ध मजदूर संगठन भारतीय मजदूर संघ (बीएमएस) ने सरकार के खिलाफ हाल में हुई कोल माइंस वर्कर्स यूनियन की सांकेतिक हड़ताल में अन्य मजदूर संगठनों के साथ मिल कर हिस्सा लिया है। यह विरोध तभी सार्थक है जब ये सब पार्टियां और संगठन नवउदारवादी आर्थिक नीतियों का भी विरोध करें। यानी विकास के पूंजीवादी माडल का विरोध।
विरोध के साथ कुछ फौरी कदम भी उठाने चाहिए। राजनीतिक पार्टियों को भूमि अधिग्रहण कानून की मजबूती के साथ, जैसा कि सोशलिस्ट पार्टी की मांग है, एक भूमि उपयोग आयोग (लैंड यूज कमीशन) बनाने की पहल करनी चाहिए। उसमें किसानों और आदिवासियों का समुचित प्रतिनिधित्व होना चाहिए। भारत के स्वतंत्रता आंदोलन में किसान आंदोलन की महत्वपूर्ण भूमिका रही है। उसके कई महत्वपूर्ण विचारक ओर नेता रहे हैं। आजादी के बाद चौधरी चरण सिंह से लेकर नंजुदास्वामी व किशन पठनायक तक खेती-किसानी के स्वरूप व समस्याओं पर गहराई से विचार करने वाले लोग हुए हैं। इस विरासत को विकास के विमर्श का हिस्सा बनाना चाहिए।

GOVERNANCE BY ORDINANCES – UNDEMOCRATIC AND UNCONSTITUTIONAL   

I am getting more and more convinced of the truth of the idiom attributed to Marx namely, “that the bourgeois government is the executive committee of the Big Business and Industrial houses”. This is sharply brought out by Modi government issuing ordinances on Increased F.D.I. in Insurance and the Coal Mines (Special Ordinance) the very next day after parliament adjourned, notwithstanding that it had over 3 weeks to get these Bills introduced and try to get them passed. Of course it is well known that B.J.P. lacks majority in Rajya Sabha. But then why it did not call for a joint session where it claims it has majority. That a devious game was deliberately being played by B.J.P. in resorting to two ordinances is clear from the Union Finance Ministers open declaration (even during parliament session) that “if the opposition did not relent, the government was ready to take a joint session route” – notwithstanding this boast the government opted for undemocratic route of ordinances. 

It is well known that there are serious differences in Parliament about the very motive of passing the amendments allowing increased F.D.I. in Insurance Sector – that is why the insurance bill has been held up for nearly six years – B.J.P. ironically was the vociferous opponent in the last Lok Sabha. The history of L.I.C. since 1956, when life insurance was nationalized by paying just 5 Crores to then private insurance companies has been a gold mine to the Union Government. L.I.C. has given to the Central government hefty amounts yearly (2008 – 09 to 2012 – 13) of Rs. 929.12 Crores, 1030.92 Crores, 1137.62 Crores, 1281.23 Crores, 1436.38 Crores respectively (It also donated Rs. 7000 Crore in 7th Plan). It defies logic why in such a situation central government should welcome F.D.I. resulting in loss to L.I.C. which will have to share premiums paid by Indian citizens to foreigners, unless it is a commitment given by Modi on his U.S.A. visit. So much is the desperate attempt to woo foreign investors that when their reaction was the expected one, namely that they would wait for regular law to be passed before risking their investment, union government came out with a convoluted version in the press that even if ordinance is not approved by the Parliament, enhanced F.D.I. made during ordinance period would remain valid and irreversible. This proposition is legally unsound because unless parliament passes the law by endorsing the ordinance, all actions under the ordinance, would be unconstitutional.

The Ordinance regarding auction of Coal Blocks is even more mischievous. I can understand that the blocks having been cancelled by the Supreme Court last year they had to be auctioned afresh. But under the cover of re-auctioning, mischievous steps are being taken to erode the provisions of Coal Mines (Nationalization Act. 1973) which provided that all rights title in relation to Coal Mines shall stand vested in the Central Government. It also provides that no person other than the Central Government or a government company or a corporation managed or controlled by Central Government can engage in mining. I am convinced that union government deliberately avoided introducing the Bill in Rajya Sabha. I say this because by the ordinance the Union Government has surreptiously indirectly amended the Coal Mines Nationalization Act, 1973. It knew very well that for B.J.P. Government to reopen nationalization by a debate in the parliament would make it run for cover and an open charge of serving the interest of its election fund donors. The ordinance is a half clever sly trick to bring private sector in coal mining after a lapse of over 40 years. People in Coal Business have explained that ordinance explicitly allows private public joint ventures and permits commercial mining by state government companies; activities which the Supreme had said were illegal. This will benefit favourite companies of Modi government that are already partnered by state government companies which lack mining expertise - an indirect method to scuttle the Coal Mining Nationalization law.

The ordinance regarding Land Acquisition is the limit of hypocricy and shows total contempt for Parliamentary system. This Act is the result of years of massive agitation by organizations like Narmada Bachao Andolan to get some justice to the evictees of land taken for the benefit of Big Business and industrialists. Surely this unanimous legislation by the previous Parliament can not be set at naught by an executive ordinance – the irony being that the Act was approved in the previous Lok Sabha by a Parliamentary Committee headed by the Present B.J.P. Lok Sabha Speaker. The puerile excuse that it was necessitated by keeping exemption of Atomic plants from the provision of the Act is phony because this would have required only amendment of Section 105. There was no urgency to dilute social impact assessment measure and the provision of enchanted compensation which was to benefit the millions of poor and dispossessed. Why does not B.J.P. openly admit that it owes a debt to big Business by displacing lakhs of farmers / poor residents so that it could open up –Delhi – Bombay corridors for the Corporate Sector for which Modis first visit to Japan was the precursor. In fact ordinance specifically empowers the govt. to exclude Industrial corridors from the applicability of the Act.

No Mr. President Mukherjee Sir, Your Excellency seeking clarification from 3 Central Ministers was only part obligation under the constitution when issuing the ordinance – the real stake holders, the millions of poor farming population needed to be consulted and heard through their well established representatives prior to issuing the ordinance especially when these organizations had also represented to you seeking a meeting.  

Ordinance making power is the legacy of British Colonialism. This should have no place in free India, nor is it to be found in any other democratic countries. But Modi Government is flouting it openly by having already readied an ordinance on Arbitration Act (what urgency can possibly explain such a bizarre move).

The Supreme Court has very strongly commented as far back it is 1987 that ordinance making power “is in the nature of emergency power to take action when the legislature is not in session. This power is to be used to meet an extraordinary situation and it can not be allowed to be” “perverted to serve political ends”. 

Thankfully Modis undemocratic exercise of power is being resisted by Trade Unions who have decided to go in Token Strike – Coal Mines Workers Union and other trade unions have also decided to hold a joint demonstration and protest before the Parliament when it holds its next session.

किसान विरोधी नीतियों के विरोध में सोशलिस्ट पार्टी का आमरण अनशन

24 नवम्बर और 15 दिसम्बर, 2014 को सोशलिस्ट पार्टी (इण्डिया) ने उन्नाव धरना देकर इस बात का विरोध किया था कि जिले में सरकारी धान केन्द्रों पर धान नहीं खरीदा जा।
दूसरे धरने के बाद जिले में दस केन्द्र खोले गए किंतु खरीद कहीं नहीं हो रही। ऐसा बताया जा रहा है कि ऊपर से आदेश है कि धान नहीं खरीदना है। निजी राइस मिलों को लाभ पहुंचाने के लिए दलालों के माध्यम से न्यूनतम समर्थन मूल्य से काफी कम, करीब रु. 1000 प्रति क्विंटल, पर धान खरीद किसानों का उत्पीड़न किया जा रहा है।
किसानों को धान के न्यूनतम समर्थन मूल्य, रु. 1400 व रु. 1360 क्रमशः ए एवं बी ग्रेड धान के लिए, की गारण्टी होनी चाहिए ओर सभी सरकारी केन्द्रों को ठीक से खोल कर चलाया जाना चाहिए। किसानों की खस्ता हालत एवं देश के कुछ इलाकों में किसानों की आत्महत्या की खबरों से सब वाकिफ हैं।
सरकार पहले राइस मिलों से 60 प्रतिशत चावल लेवी के रूप में लेती थी। अब इसको कम कर 25 प्रतिशत कर दिया गया है और अगले वर्ष से 0 प्रतिशत कर दिया जाएगा। सरकार द्वारा यह कदम किसान को बाजार पर निर्भर बनाएगा।
राज्य सरकार ने 2012 में राज्य पूल बंद कर भी किसानों के लिए संकट खड़ा कर दिया है। जहां पहले 30-40 लाख टन अनाज खरीदा जाता था अब सिर्फ 9-10 लाख टन खरीदा जाता है। जबकि उ.प्र. पहला राज्य है जिसने राज्य पूल शुरु किया था।
दूसरी तरफ भू अधिग्रहण कानून में 2013 में किए गए संशेधनों को कमजोर कर उसे भी किसान विरोधी बनाया जा रहा है। पहले जो अधिग्रहण के लिए 70 प्रतिशत किसानों की सहमति अनिवार्य थी उसे समाप्त किया जा रहा है। इसी तरह भू अधिग्रहण के पहले जन सुनवाई तथा सामाजिक प्रभाव के अध्ययन की आवश्यकता को समाप्त किया जा रहा है। स्पष्ट है कि सरकार किसानों की जमीन मनमाने तरीके से हड़प कर उद्योगपतियों को औने-पौने दामों पर देना चाहती है।
स्पष्ट है कि सरकार कृषि को भी बाजार के हवाले करना चाहती है जो जन विरोधी कदम होगा। केन्द्र व राज्य सरकारों की किसान विरोधी नीतियों के खिलाफ सोशलिस्ट पार्टी के नेता अनिल मिश्र 8 जनवरी, 2015 से आमरण अनशन पर बैठेंगे।
– किसान को न्यूनतम समर्थन मूल्य की गारण्टी दी जाए।
– सरकारी धान खरीद केन्द्रों को सक्रिय किया जाए।
– लेवी खत्म करने का निर्णय वापस लिया जाए।
– राज्य पूल को पुनस्र्थिापित किया जाए।
– भू-अधिग्रहण कानून में अध्यादेश लाकर किए गए संशोधन को वापस लिया जाए। भूमि अधिग्रहण हेतु 70 प्रतिशत किसानों की सहमति, जन सुनवाई व सामाजिक प्रभाव अध्ययन को अनिवार्य बनाया जाए।
– स्वास्थ्य बजट में रु. 6000 करोड़ की कटौती वापस ली जाए।
– बीमा क्षेत्र में विदेशी पूंजी निवेश आमंत्रित करने का निर्णय वापस लिया जाए।
– निजीकरण की नीति पर रोक लगाई जाए। शिक्षा और स्वास्थ्य के क्षेत्र इससे पूर्णतया मुक्त रखे जाएं।
– समान शिक्षा प्रणाली व पड़ोस के विद्यालय की अवधारणा लागू की जाए। सरकारी वेतन पाने वाले व जन प्रतिनिधियों के बच्चों का सरकारी विद्यालयों में पढ़ना अनिवार्य किया जाए।
– न्यूनतम दैनिक मजदूरी रु. 440 प्रति दिन व संविदा कर्मचारियों की तनख्वाह रु. 11,000 प्रति माह की जाए।
– रोजगार का अधिकार मौलिक अधिकार बनाओ।
– 80 प्रतिशत बिजली एवं अन्य संसाधन गांवों के लिए आरक्षित किए जाएं।
– रु. 500 व रु. 1000 के नोट पर रोक लगे ताकि बड़े भ्रष्टाचार पर रोक लगे।
– जेलों में बंद निर्दोष लोगों या जो लम्बे समय से जेल में हैं को रिहा किया जाए।

Joint Protest Rally Against Land Acquisition Ordinance and Insurance Ordinance


The Socialist Party (India), Lal Nishan Party (Leninist), the All India Insurance Employees Association (Pune unit) and Lokayat have decided to organise a joint protest rally against the recent ordinances, especially the Land Acquisition Ordinance and the Insurance Ordinance, promulgated by the Modi government that reveal completely its anti-people and undemocratic agenda. While thus implementing policies that favour naked profiteering and transfer of public resources of our country to foreign and Indian corporate houses, at the same time it has also launched a brutal offensive to further reduce the already low subsidies given to the people, including education and health subsidies.

We invite you all to join us in this rally and make it a joint protest of all progressive organisations. Do let us know if you would like to participate. If yes, then do reply back or sms me, and we shall include the name of  your organisation in the press release and the pamphlet.

We talked amongst each other and decided not to call a joint meeting of all progressive organisations before finalising the program as that would delay the whole plan of taking out the rally, as it is, the proposed date is a bit late. We hope you do not mind us finalising the date amongst a few of us and then informing all of  you.

We have also talked to Justice Kolse Patil, Anant Phadke and Abhay Shukla regarding this plan, and they have all expressed their support. This email is being sent out with their approval too.

The proposed date and time for the protest rally are as below:

Date: January 10, Saturday
Time: 5.30 pm: Assembly at Senapati Bapat Putla, Alka Talkies Chowk, and we then March from there to Tilak Putla, Mahatma Phule Mandai. We should reach Phule Mandai at 7 pm.
            7 - 8 pm: Public Meeting at Tilak Putla, Phule Mandai.
